YouTuber Arrested for Insulting the Prime Minister Released

Release of Roshan Pokharel fuels debate over free speech, cyber law enforcement, and political tolerance in Nepal

The arrest and subsequent release of a YouTuber accused of abusing Balen Shah has triggered widespread criticism in Nepal, raising questions over free speech and cyber law enforcement. The case has quickly escalated into a broader political debate, drawing reactions across social media platforms.

Roshan Pokharel, a resident of Falgunanda Rural Municipality–7 in Panchthar, was detained on april 9 for allegedly publishing abusive content targeting the prime minister and other political leaders on YouTube.

He was later released on the condition that he would appear when required, according to DSP Anish Karn of the District Police Office Panchthar.

Cyber Arrest Sparks Free Speech Debate

Pokharel’s arrest followed an investigation by Nepal Police’s Cyber Bureau, which led local authorities to detain him under cybercrime-related charges. A district court had granted a 10-day remand for further inquiry.

However, his detention has sparked intense debate online, with critics questioning whether the move represents a crackdown on dissent or a justified legal action against abusive content. Legal experts and civil society voices have pointed to growing concerns about how cyber laws are being applied, particularly when political figures are involved.

Social Media Reaction Targets Balen Shah

Following the arrest, social media platforms saw a surge in criticism directed at Balen Shah. Users began sharing his past Facebook posts and videos, drawing comparisons and accusing authorities of selective enforcement.

The backlash reflects a wider frustration among sections of the public who view the incident as inconsistent with democratic values, especially regarding freedom of expression. Supporters of Shah, however, argue that abusive and defamatory content should not be tolerated and that legal action is necessary to maintain accountability online.

Growing Tension Over Cyber Law Enforcement

The case highlights an ongoing tension in Nepal between regulating harmful digital content and protecting individual rights. Authorities have increasingly relied on cybercrime laws to address online abuse, but critics say the line between enforcement and suppression remains unclear.

As Pokharel remains under legal scrutiny despite his release, the incident is likely to intensify discussions around digital rights, political accountability, and the role of law enforcement in Nepal’s evolving online landscape.
