A habeas corpus petition has been filed at the Supreme Court challenging the detention of former Prime Minister KP Sharma Oli, as legal proceedings intensify following his arrest.
The petition was submitted on Sunday by Oli’s spouse, Radhika Shakya, seeking judicial review of his custody. A Supreme Court official confirmed that the filing is currently under review. This follows a separate petition registered earlier, indicating growing legal pressure surrounding the case.
Oli was arrested on Saturday morning from his residence in Bhaktapur’s Gundu area. Authorities took him into custody based on findings from an investigation commission formed to examine incidents that occurred on Bhadra 23 and 24. The commission’s report recommended further legal action, prompting police to initiate an investigation.
In parallel, law enforcement officials presented Oli before the Kathmandu District Court through virtual means to seek an extension of his detention. Government prosecutors have requested a 10-day remand to continue inquiries into the case.
The hearing is being conducted under the bench of District Court Judge Anand Shrestha. Legal representatives from both sides have presented their arguments, focusing on whether to grant the extension of custody for both Oli and former Home Minister Ramesh Lekhak, who is also implicated in the same case.
The Oli habeas corpus petition has drawn attention as it questions the legality of the arrest and detention process. Legal experts say the court’s interpretation could have broader implications for due process and the handling of politically sensitive investigations.
The court is expected to issue an order on whether to approve the remand extension while the Supreme Court proceeds with its review of the habeas corpus petition, a decision that may shape the next phase of this high-profile case.
