Nepal Supreme Court to Deliver Verdict on Writ Challenging Investigation Commission

Nepal’s Supreme Court is preparing to deliver a verdict on a writ petition challenging the investigation commission formed to probe the Bhadau 23 and 24 incidents.

KATHMANDU — Nepal’s Supreme Court is set to deliver a verdict on a writ petition challenging the investigation commission formed to probe the incidents that occurred on Bhadau 23 and 24. The commission is headed by former judge Gauri Bahadur Karki.

The writ petition was filed on Kartik 18, seeking an order to prevent the commission’s chairperson and all members from carrying out any official work until the court issues a final decision. A joint bench of Justices Manoj Kumar Sharma, Nahakul Subedi, and Shrikant Paudel on Friday scheduled the case for a verdict.

The petition was filed by advocate Bipin Dhakal against the commission and its office bearers. It argues that appointing an individual with a preconceived stance as chairperson violates the principle of natural justice upheld by Nepal’s judicial system.

According to the petition, Chairperson Karki shared news reports and gave media interviews related to matters that fall within the commission’s own scope of investigation. The writ claims such actions breach the principles of fair hearing and presumption of innocence.

The commission’s members include Gyanraj Sharma and Bishweshwar Prasad Bhandari. The petitioner has sought an interim order barring the chairperson and members from performing any duties or exercising authority until the court reaches a final conclusion on the case.

The Supreme Court had earlier scheduled verdict dates for Mangsir 25 and Poush 3, but the decision was postponed on both occasions. The court is now preparing to issue its ruling.
